Welcome to fyne. The terms of service govern the purchase and use of products and services offered by fyne through its website and other sales channels. For the purposes of these terms:

• fyne, we, us or our means fyne, the business providing the products and services described on this website.

• Purchaser, you or your means the individual or legal entity purchasing products or services from fyne.

• Products means any physical goods, handmade items, artwork, furniture, designs, custom pieces or other products offered by fyne, whether standard or custom.

• Custom means any artwork, design, product, or other item created, modified or personalized specifically according to your request, specifications, materials, measurements or approval.

• Services means the design, artwork, customization, production and other services provided by fyne.

• Website means fyne’s website and any associated online store, pages or digital platforms operated by fyne.

By placing an order, purchasing a product, requesting custom work or otherwise using fyne’s website or services, you agree to be bound by these terms. These terms apply to all purchases and services unless agreed otherwise in writing.

Each piece created by fyne is made with care and attention to detail. Because many of our products are handmade, natural variations in color, texture, grain, finish, dimensions and appearance may occur. These variations are characteristics of handmade and natural materials and are not considered defects.

The products and services may be available exclusively through our website and may be available in limited quantities only. fyne reserves the right to limit quantities or decline orders where reasonably necessary.

Product photographs are provided for illustration. Colours may appear slightly different depending on your screen, lighting, photography and the natural characteristics of the materials used.

fyne reserves the right at any time to modify, suspend or discontinue any product, service or any part or content thereof, without notice. fyne shall not be liable to you or any third party for any modification, price change, suspension or discontinuance of the service, except where otherwise required by applicable law. Prices for products and services are subject to change without notice.

fyne offers custom artwork, designs and personalized products based on information, images, measurements, specifications and other materials provided by the customer. You are responsible for ensuring that all information provided to us is accurate and complete. Custom work has to be requested and agreed to in writing by both parties prior to commencement. Once a custom work and its scope has been approved by you, production may begin. Changes requested after approval may result in additional fees, delays, or both. fyne reserves the right to decline any request that is considered inappropriate, unlawful, infringing or outside the scope of offered services. fyne reserves the right to discontinue any product or service at any time.

All designs, artwork, concepts, sketches, drawings, digital files, patterns, layouts and other creative work produced by fyne remain the sole property and intellectual property of fyne, unless expressly agreed otherwise in writing.

Purchasing a product, service or commissioning custom work from fyne does not transfer ownership or intellectual property rights in the underlying design to you. You may not reproduce, copy, modify, distribute, resell, license or commercially exploit any fyne design, artwork, concept or creative work without fyne’s prior written consent. fyne retains the right to use its designs and completed work for its portfolio, website, social media, marketing, advertising and other promotional purposes.

Occasionally, information on fyne’s website or within the service may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability.

fyne reserves the right to correct errors, inaccuracies or omissions and to update information or cancel affected orders where necessary.

If an order is cancelled due to an error for which payment has already been made, fyne will provide an appropriate refund.

Shipping, delivery, returns, exchanges, damaged products and cancellations are governed by fyne's shipping & return policy, which forms part of these terms.

In addition to other prohibitions set forth in these terms, you are prohibited from using the site or its content:

• for any unlawful purpose;

• to solicit others to perform or participate in unlawful acts;

• to violate applicable laws, regulations, or ordinances;

• to infringe or violate fyne's intellectual property rights or the intellectual property rights of others;

• to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate against others;

• to submit false or misleading information;

• to upload or transmit viruses or malicious code;

• to collect or track the personal information of others without authorization;

• to spam, phish, scrape, crawl or otherwise misuse the website;

• for any unlawful, obscene or otherwise prohibited purpose; or

• to interfere with or circumvent the security features of the service or the website.

fyne reserves the right to terminate agreements or restrict access for violations of these terms.

To the fullest extent permitted by applicable law, fyne provides its products, designs, artwork, services, website, and all related content on an “as is” and “as available” basis, without any warranties, representations or guarantees, whether express, implied, statutory or otherwise.

fyne makes no warranty or guarantee that any product, design, artwork, service, website or content will be uninterrupted, error-free, accurate, reliable, suitable for any particular purpose or meet your expectations.

To the fullest extent permitted by law, fyne disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement.

You acknowledge that handmade products may contain natural variations in materials, color, texture, grain, finish, dimensions and appearance. Such variations are an inherent characteristic of handmade products and do not constitute a warranty or guarantee of uniformity.

To the fullest extent permitted by applicable law, fyne shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, including loss of profits, revenue, business, opportunities, data, goodwill or anticipated savings, arising out of or relating to any product, service, order, design, artwork, website, delay or use of the service.

To the fullest extent permitted by applicable law, the total liability of fyne for any claim arising out of or relating to a product or service shall not exceed the amount actually paid by you to fyne for the specific product or service giving rise to the claim.

fyne shall not be responsible for damage, loss, delay or failure resulting from circumstances beyond its reasonable control, including shipping delays, carrier errors, incorrect information supplied by the purchaser, misuse or improper handling of products, unauthorized modifications, normal wear and tear or events outside fyne's control.

Nothing in these terms is intended to exclude or limit any liability, warranty, guarantee or consumer right that cannot legally be excluded or limited under applicable law.

These terms, as well as underlying policies, and any separate agreements under which fyne provides products or services shall be governed by and construed in accordance with the laws of Switzerland, without regard to conflict-of-law principles.

Any disputes arising from these terms or the products or services provided by fyne shall be subject to the jurisdiction of the courts having authority under Swiss law.

Nothing in this section limits any mandatory consumer protections or rights applicable to you.

If any provision of these terms is determined to be unlawful, void or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law and the unenforceable portion shall be deemed severed from these terms.

The collection, use, storage, protection and handling of personal data/information are governed by fyne's privacy policy, which forms part of these terms.

fyne may update these terms from time to time to reflect changes to our business, website, services, technology or applicable legal requirements.
